1. OUR APPROACH TO PRIVACY

Amerus LLC, a Florida limited liability company (“Amerus LLC,” “Amerus,” “we,” “us,” or “our”), provides the Amerus personal artificial intelligence application and related software and services (“Amerus”).

Amerus is built differently.

Amerus is structurally designed to reside and operate locally on the User’s computer or other authorized device (“Device”). The core Amerus artificial intelligence system processes information locally rather than routinely sending a User’s information to Amerus LLC or an externally hosted artificial intelligence model.

This means that the documents, conversations, prompts, memories, locally stored knowledge, personal information, and other content a User places in Amerus are designed to remain on that User’s Device unless the User affirmatively chooses to send, share, retrieve, download, back up, or otherwise communicate information outside the Device.

This Privacy Policy explains that architecture, the limited information Amerus LLC may separately receive in operating its business, and the choices Users have regarding their information.

By downloading, installing, accessing, or using Amerus, User acknowledges this Privacy Policy and the Amerus Terms and Conditions of Use (“Terms”).

2. THE IMPORTANT DISTINCTION: USER CONTENT VS. AMERUS BUSINESS INFORMATION

Amerus distinguishes between two fundamentally different categories of information:

User Content is the information a User places into or creates through the locally operated Amerus application.

Amerus Business Information is limited information Amerus LLC may receive separately in order to sell, license, support, secure, update, or administer Amerus and operate its business.

These categories are treated differently.

3. USER CONTENT

3.1 What Is User Content?

“User Content” includes information supplied to, stored within, created through, or processed locally by Amerus, including:

• (a) conversations with Amerus;
• (b) prompts and questions;
• (c) documents and files;
• (d) photographs and other media;
• (e) personal notes and records;
• (f) locally stored memories and preferences;
• (g) locally maintained knowledge and reference materials;
• (h) information imported by the User;
• (i) AI-generated responses and other outputs; and
• (j) other information maintained locally through Amerus.

User Content may include personal, business, confidential, financial, medical, legal, family, proprietary, or other sensitive information selected by the User.

3.2 User Content Stays Local

Amerus is structurally designed so that User Content is processed and stored locally on the User’s Device.

Except when a User affirmatively initiates, enables, or authorizes functionality that requires communication outside the Device:

Amerus LLC does not receive User Content.

Amerus LLC does not maintain a cloud copy of User Content.

Amerus LLC does not send User Content to an externally hosted artificial intelligence model for processing.

Amerus LLC does not use User Content to train shared, public, or externally hosted artificial intelligence models.

Amerus LLC does not sell User Content.

The fact that User Content may contain sensitive information does not itself cause that information to be transmitted to Amerus LLC.

3.3 Your Information Is Yours

As between Amerus LLC and the User, User retains ownership of User Content.

To the extent permitted by applicable law, Amerus LLC claims no ownership interest in the User’s prompts, conversations, documents, locally stored memories, personal knowledge, files, or AI-generated outputs created specifically for that User.

4. WHEN INFORMATION MAY LEAVE THE DEVICE

Amerus’s local design does not mean that a Device can never communicate with the internet.

Information may leave the Device when the User affirmatively initiates, enables, or authorizes functionality requiring external communication.

Examples may include when a User:

• (a) downloads Amerus, an AI model, an update, or additional information;
• (b) directs Amerus to retrieve information from the internet;
• (c) connects Amerus to a third-party account, storage service, application, or other integration;
• (d) imports information stored with a third party;
• (e) directs Amerus to send, share, publish, upload, or otherwise transmit information;
• (f) creates or enables an external or cloud-based backup;
• (g) contacts Amerus LLC for support and elects to provide information or files;
• (h) uses an optional connected feature; or
• (i) otherwise instructs Amerus to communicate with a person, website, application, service, or system outside the Device.

When a User directs Amerus to interact with an external service, the information necessary to perform that request may be transmitted to the applicable third party.

Information received by a third party is subject to that third party’s privacy practices, terms, and security measures. Amerus LLC does not control the privacy or security practices of third parties selected or authorized by the User.

5. NO AMERUS CLOUD BACKUP

Amerus’s privacy architecture has an important consequence:

Amerus LLC ordinarily does not possess a backup of User Content.

Unless Amerus LLC expressly identifies a particular optional service as providing external storage or backup, there is no Amerus LLC cloud copy of the User’s Amerus system, documents, conversations, memories, personal knowledge, files, or other User Content.

Unless the User independently creates or enables a backup, the information on the User’s Device may be the only copy that exists.

Amerus LLC therefore may be unable to recover User Content if it is lost.

Loss, theft, failure, corruption, damage, replacement, reset, or destruction of the Device or its storage, or deletion or corruption of Amerus or User Content, may result in the permanent and irrecoverable loss of User Content.

User is responsible for deciding whether and how to create backups.

If User creates a backup using an external drive, network storage, cloud service, operating-system backup service, or another third-party service, that backup is created and controlled by the User. The privacy and security of any third-party backup are subject to the User’s configuration and the practices of the applicable third party.

6. INFORMATION AMERUS LLC MAY RECEIVE

Although Amerus LLC ordinarily does not receive User Content, Amerus LLC may receive limited information necessary to provide, license, sell, secure, update, and support Amerus.

Depending upon the services used, this may include:

6.1 Account and Purchase Information

Amerus LLC may receive information such as:

• (a) name;
• (b) email address;
• (c) account or customer identifier;
• (d) subscription or license status;
• (e) purchase history;
• (f) billing address;
• (g) transaction information; and
• (h) other information voluntarily provided during purchase or account creation.

6.2 Payment Information

Payments may be processed by third-party payment processors.

Amerus LLC may receive transaction status, payment confirmation, billing information, or limited payment-method information necessary to administer a transaction.

Amerus LLC does not need to receive or store complete payment-card information when payment is processed directly by a third-party payment processor.

6.3 Licensing, Updates, and Technical Information

When Amerus communicates with Amerus LLC systems for activation, license verification, security, or updates, Amerus LLC may receive limited technical information reasonably necessary to perform those functions.

Depending upon implementation, this could include:

• (a) software version;
• (b) operating-system type or version;
• (c) license or installation identifier;
• (d) Device type or general technical characteristics;
• (e) IP address necessarily associated with an internet communication;
• (f) date and time of a request; and
• (g) information necessary to determine whether an update or license is applicable.

Amerus LLC will not intentionally use these technical communications to obtain User Content.

6.4 Support Communications

When User contacts Amerus LLC, Amerus LLC will receive the information User chooses to provide.

Because Amerus LLC ordinarily cannot see User Content stored on the Device, a User seeking technical support may elect to provide screenshots, logs, files, or other information.

Users should not provide sensitive User Content to Amerus LLC for support unless they determine it is necessary and appropriate to do so.

Information voluntarily provided to Amerus LLC for support is no longer exclusively local information and may be retained as reasonably necessary to resolve the request and maintain appropriate business records.

7. INFORMATION WE DO NOT NEED TO COLLECT FROM LOCAL USE

Amerus LLC does not need access to the substance of a User’s locally processed conversations, documents, personal knowledge, memories, or prompts in order for the core local artificial intelligence system to operate.

Accordingly, Amerus LLC does not intentionally collect such User Content merely for purposes such as:

• (a) advertising;
• (b) creating advertising profiles;
• (c) selling User data;
• (d) training shared artificial intelligence models;
• (e) monitoring the substance of User conversations;
• (f) building behavioral profiles based upon locally processed User Content; or
• (g) allowing Amerus personnel to review the User’s locally stored personal information.

8. HOW AMERUS LLC USES BUSINESS INFORMATION

Amerus LLC may use Amerus Business Information to:

• (a) process purchases and subscriptions;
• (b) establish and administer licenses;
• (c) provide software and security updates;
• (d) communicate important service or security information;
• (e) provide customer support;
• (f) prevent fraud, abuse, or unauthorized licensing;
• (g) maintain appropriate accounting, tax, and business records;
• (h) comply with applicable law;
• (i) protect the rights, property, and security of Amerus LLC and its Users; and
• (j) improve the reliability and operation of Amerus without requiring access to the substance of locally stored User Content.

9. ARTIFICIAL INTELLIGENCE TRAINING

Amerus’s local architecture is specifically intended to separate the User’s private use of artificial intelligence from externally hosted artificial intelligence training systems.

Amerus LLC does not use locally processed User Content to train shared, public, or externally hosted artificial intelligence models.

User prompts, documents, conversations, memories, personal knowledge, and locally generated interactions do not become part of an Amerus LLC training dataset merely because User uses Amerus.

If Amerus LLC ever offers an optional program allowing Users voluntarily to contribute information for product development or model improvement, participation will require an affirmative choice by the User and will be subject to disclosures applicable to that program.

10. SHARING OF AMERUS BUSINESS INFORMATION

Amerus LLC may disclose limited Amerus Business Information to service providers when reasonably necessary to operate its business, such as payment processors, licensing providers, email providers, customer-support providers, professional advisers, security providers, and technology vendors.

Such sharing does not give those service providers access to User Content that Amerus LLC itself does not possess.

Amerus LLC may also disclose information:

• (a) when required by applicable law, subpoena, court order, or lawful governmental process;
• (b) when reasonably necessary to protect the rights, property, or safety of Amerus LLC, Users, or others;
• (c) in connection with suspected fraud or unlawful activity; or
• (d) in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar corporate transaction.

11. GOVERNMENT AND LEGAL REQUESTS

Because Amerus LLC ordinarily does not possess User Content stored locally on the User’s Device, Amerus LLC ordinarily cannot produce information it does not possess.

Amerus LLC may, however, be required to disclose Amerus Business Information actually in its possession when legally compelled to do so.

Nothing in this Privacy Policy prevents Amerus LLC from complying with applicable law or a valid legal order.

12. DATA RETENTION

12.1 User Content

Amerus LLC does not establish a retention period for User Content that remains exclusively on the User’s Device because Amerus LLC does not possess or control that information.

The User controls how long locally stored User Content remains on the Device.

Deleting locally stored User Content is the User’s responsibility.

12.2 Amerus Business Information

Amerus LLC retains Amerus Business Information only for as long as reasonably necessary for the purposes for which it was collected, to operate its business, maintain transaction and licensing records, resolve disputes, enforce agreements, prevent fraud, or satisfy legal, tax, accounting, or regulatory requirements.

Different categories of business information may therefore have different retention periods.

13. DATA SECURITY

Amerus’s local architecture is designed to reduce the amount of User information transmitted to or maintained by Amerus LLC.

However, no computer or storage system is absolutely secure.

The security of locally stored User Content depends in substantial part upon the security of the User’s Device and the safeguards selected by the User.

Users are responsible for maintaining appropriate:

• (a) passwords and access controls;
• (b) Device encryption;
• (c) operating-system security updates;
• (d) physical security;
• (e) malware protection where appropriate;
• (f) backup procedures; and
• (g) security for any third-party storage or backup service selected by User.

Loss, theft, malware, unauthorized Device access, compromised credentials, or other events may expose User Content even though Amerus LLC never received that information.

14. COOKIES AND THE AMERUS WEBSITE

The Amerus application does not need browser cookies to process locally stored User Content.

The Amerus website, purchasing system, support site, or other web-based services may use cookies or similar technologies necessary for website operation, security, purchases, account functions, preferences, or analytics.

Where required by applicable law, Users will be provided appropriate choices regarding non-essential cookies or tracking technologies.

Website activity should not be confused with the content of a User’s locally operated Amerus application.

15. USER PRIVACY RIGHTS

Depending upon where a User resides, applicable privacy laws may provide rights concerning personal information actually held by Amerus LLC, including rights to request access, correction, deletion, or portability and rights concerning certain uses or disclosures of personal information.

Amerus LLC will honor applicable privacy rights as required by law.

These rights necessarily apply only to information Amerus LLC possesses or controls.

For example, Amerus LLC cannot provide, correct, export, recover, or delete a locally stored Amerus conversation or document that was never transmitted to Amerus LLC.

The User controls such locally stored information directly through the User’s Device and Amerus.

16. CHILDREN’S PRIVACY

Amerus is not directed to children under thirteen (13), and Amerus LLC does not knowingly collect personal information from children under thirteen through its business systems except as permitted by applicable law.

Because locally stored User Content is not ordinarily transmitted to Amerus LLC, Amerus LLC may not know the age or identity of individuals whose information a User stores locally.

Parents and guardians are responsible for supervising a minor’s use of Amerus when such use is permitted.

17. INTERNATIONAL USERS

Because User Content is processed locally, the ordinary local use of Amerus does not require Amerus LLC to transfer that User Content internationally.

Amerus Business Information may be processed in the United States or other locations where Amerus LLC’s service providers operate, subject to applicable privacy requirements.

When User independently directs Amerus to communicate with a third-party service, the location and processing practices of that third party are governed by the User’s relationship with that service and its applicable policies.

18. THIRD-PARTY SERVICES

Amerus may allow User to communicate with websites, applications, storage providers, connected accounts, data sources, or other third-party services.

The User decides whether to use such services.

Once information is intentionally transmitted to a third party, that third party’s privacy policy and terms govern its possession and use of that information.

Amerus LLC is not responsible for the privacy, security, accuracy, or practices of third-party services not controlled by Amerus LLC.

19. CHANGES TO THIS PRIVACY POLICY

Amerus LLC may update this Privacy Policy from time to time to reflect changes in Amerus, applicable law, technology, or business practices.

For material changes affecting an ongoing relationship with User, Amerus LLC will provide reasonable notice through Amerus, email, its website, or another reasonable method as appropriate.

The effective date of the current Privacy Policy will appear at the beginning of this Policy.

20. CONTACTING AMERUS LLC

Questions or requests concerning this Privacy Policy or personal information actually maintained by Amerus LLC may be submitted using the privacy contact information made available within Amerus or on the official Amerus website.

Formal notices may also be sent to the business or legal address designated by Amerus LLC.

21. GOVERNING LAW

This Privacy Policy shall be governed by applicable law and, to the extent permitted by applicable law, the laws of the State of Florida, without regard to conflict-of-law principles.

THE AMERUS PRIVACY PRINCIPLE

Amerus is designed around a simple principle:

Your personal AI should be personal.

Your conversations, documents, memories, knowledge, and other locally processed User Content are designed to remain on your computer.

They are not routinely sent to Amerus LLC.

They are not sent to an outside AI model for processing unless you affirmatively use or authorize functionality requiring such communication.

They are not used by Amerus LLC to train a shared or externally hosted AI model.

Amerus LLC does not maintain a cloud backup of them unless a specific optional service expressly provides otherwise.

What stays on your computer remains distinctly yours.
